Abstract


Abstract

This study aims to analyze the discourse of Daniel S. Lev's thoughts on the existence of religious courts in Indonesia, this is done by descriptive-interpretive methods to socio-historically describe the position of religious courts since colonial times until today. the context in which the balance in the political constellation regarding the 'religious-socio-political cleavage' between supporters and opponents of the Religious courts has been reversed, the question of which system is conquering, and which system is being conquered becomes problematic. In Indonesia today, a dual legal system in which civil law and Islamic legal traditions coexist is no longer politically disputed. By extension, the convergence of civil and Islamic legal systems no longer implies the conquest of religious courts by civil law systems. It may also be the other way around.

Abstrak

Penelitian ini bertujuan menganalisis diskursus pemikiran Daniel S. Lev terhadap eksistensi pengadilan Agama di Indonesia, hal ini dilakukan dengan metode deskriptif-interpretatif mengurai secara sosio-historis posisi Pengadilan Agama sejak zaman kolonial hingga saat ini. konteks di mana keseimbangan dalam konstelasi politik mengenai 'pembelahan agama-sosial-politik' antara pendukung dan penentang pengadilan Agama telah terbalik, pertanyaan tentang sistem mana yang menaklukkan, dan sistem mana yang sedang ditaklukkan menjadi bermasalah. Di Indonesia saat ini, sistem hukum ganda di mana hukum perdata dan tradisi hukum Islam hidup berdampingan tidak lagi dipermasalahkan secara politis. Dengan perluasan, konvergensi sistem hukum sipil dan Islam tidak lagi menyiratkan penaklukan pengadilan Agama oleh sistem hukum sipil. Mungkin juga sebaliknya.
